We provide you access to our products and services through our “Website” or “Platform” (defined below) subject to the following Terms of Service, which may be updated by us from time to time without notice to you. By browsing the public areas or by accessing and using the Website, you acknowledge that you have read, understood, and agree to be legally bound by the terms and conditions of these Terms of Service and the terms and conditions of our Privacy Policy, which are hereby incorporated by reference (collectively, this “Agreement”).     • • "Applicable Law" means in respect of a person, any statute, law, regulation, ordinance, rule, judgment, decree, by-law, approval from the concerned authority, government resolution, order, directive, guideline, policy, requirement, or other governmental restriction or any similar form of decision, or determination, or any interpretation or adjudication having the force of law of any of the foregoing, by any concerned authority or other requirements of any governmental or regulatory authority, to which such person is subject;
    • • "Buyer” or “User” Account shall mean an electronic account opened by the Buyer/User with the Platform to purchase the Products or take the services offered through the Platform;

    • • All references to singular include plural and vice versa and the word "includes" should be construed as "without limitation".
    • • Words importing any gender shall include all the other genders.
    • • Reference to any statute, ordinance or other law includes all regulations and other instruments and all consolidations, amendments, re-enactments or replacements for the time being in force.
    • • All headings, bold typing and italics (if any) have been inserted for convenience of reference only and do not define limit or affect the meaning or interpretation of the terms of this Agreement.

  • INTRODUCTION AND SCOPE

    • • Eligibility: Certain Service of the Website is not available to minors under the age of 18 or to any users suspended or removed from the system by us for any reason. Additionally, users are prohibited from selling, trading, or otherwise transferring their accounts to another party.

      We provides various services, including but not limited to the following (“Services”):

    • a. Simplifying facility of loans to Users by various banks, NBFCs and other financial service providers who are partnered with us;
    • b. Assisting the Users to obtain a credit card or other financial products from various banks who are partnered with us;
    • c. Assisting the Users with insurance offers from our partners;
    • d. Provision of support to the Users in verifying the financial capabilities of Users;
    • e. Assisting the Users to purchase products from our Website on credit basis.

  • For the provision of the above-mentioned Services, we will be using and sharing the information of the User with multiple financial institutions and other parties, as may be required for the purpose mentioned above and we shall also run multiple credit checks to be able to get the best available offers to suit the needs of the Users. The collection, storing, use and transfer of information shared by the User shall be governed in accordance with the Privacy Policy.

    ORDERING

    • • Any order for the supply of Product or Services from this Website is between you and Megoai Solutions Private Limited. You agree to take particular care when providing us with your details and warrant that these details are accurate and complete at the time of ordering. You also warrant that the credit or debit card details that you provide is your own credit or debit card and that you have sufficient funds to make the payment.
    • • Product purchased from this Website are intended for your use only and you warrant that any Goods purchased by you are not for resale and that you are acting as principal only and not as agent for another party when receiving the Services.
    • • When ordering from this Website you may be required to provide a username and password. You must ensure that you keep these details secure and do not provide this information to a third party.
    • • We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website
    • • Any order that you place with us is subject to product availability and acceptance by us. When you place your order online we will send you an email to confirm that we have received it. This email confirmation will be produced automatically so that you have confirmation of your order details. The fact that you receive an automatic confirmation does not necessarily mean that we will be able to meet your order. Once we have sent the confirmation email we will then check availability and contact you with a further email. If the Goods are available and the details of the order are correct, this email will be deemed an acceptance and will specify delivery details and confirm the price of the Goods purchased. If the Goods are not available we will also let you know by email.
    • • All prices listed on the Website are correct at the time of publication however we reserve the right to alter these in the future. We also reserve the right to alter the product or services available for sale on the Website and to discontinue any product line or service
    • • The contract for the products or services will be accepted at the time of installation of your order. We will confirm this to you in writing. You must inform us immediately if any details are incorrect. If your order has not been accepted you will be notified of this in writing together with the reasons.

    This is an Agreement for Services, and you are not granted a license to any software by this Agreement. You will not, directly or indirectly: reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, object code, or underlying structure, ideas, or algorithms of or included in the Services or any software, documentation or data related to the Services (“Software”); modify, translate or create derivative works based on the Services or any Software; or copy (except for archival purposes), distribute, pledge, assign or otherwise transfer or encumber rights to the Services or any Software; use the Services or any Software for timesharing or service bureau purposes or otherwise for the benefit of a third party; or remove any proprietary notices or labels.

    • • All prices listed on the Website are correct at the time of publication however we reserve the right to alter these in the future. Prices are exclusive of the relevant sales tax.
    • • The total price for product or service ordered, will be displayed on the Website when you place your order.
    • • Payment for your order may be achieved by way of loan from our website.

    • DESCRIPTION OF SERVICE AND PRODUCTS

    • • The Company provides an opportunity for You to purchase the Products from Company Website. Upon placing order, the Company shall ship the Product to You and will be entitled to its payment for the Services.

However, the colours visible to You is solely dependent on your computer or Mobile Screens. Hence, no guarantee is provided by the Company regarding your visibility of the colours on the Website/s or other Mobile Mediums
    • • The Company does not provide any warranty or guarantee that the Product descriptions are accurate, complete, reliable, current, or error-free. If a Product offered by the Website/s is not as described, Your sole remedy is to return it in unused, unsoiled and resale condition.

    • BUYER’S OBLIGATION AND COVENANTS TOWARDS THE PRODUCTS

      In addition to Buyer’s other covenants in this Agreement, by ordering Product/s on the Website/s You acknowledge and agree that:
      • • That any non-delivery or wrong delivery of the Products by the Company due to error in the information provided by Buyer, then, any re-delivery cost in addition to the initial cost will be billed to the Buyer;

    GOVERNING LAW AND JUDICIAL RECOURSE

    The terms herein will be governed by and construed in accordance with the laws of India without giving effect to any principles or conflicts of law. The courts of Mumbai, Maharastra shall have exclusive jurisdiction over any dispute arising from use of the Platform.

    FORCE MAJEURE

    We will have no liability to you, your users, or any third party for any failure us to perform its obligations under these Terms in the event that such non-performance arises as a result of the occurrence of an event beyond the reasonable control of us, including, without limitation, an act of war or terrorism, natural disaster, failure of electricity supply, riot, civil disorder, or civil commotion or other force majeure event.

    HOSTING SERVICES

    We have entered into arrangements with one or more third parties for hosting services that are essential to the Services, incorporated within the Services and without which the Services could not be provided to you.

    ASSIGNMENT

    The Company shall have the right to assign/transfer these presents to any third party including its holding company, subsidiaries, affiliates, associates and group companies, without any consent of the Buyer.
